PRIVACY POLICY

1. Who we are and what this covers

Orthogonal Art and Science LLC, dba Newfangled Audio ("NFA," "we," "us") operates:

  • newfangledaudio.com, including our online store;

  • al.audio;

  • the A.L. Licensing System — A.L. Accounts, license codes, license activation and management for our audio plug-ins ("Plug-Ins");

  • the Plug-Ins themselves.

We refer to all of these together as the "Services." This policy tells you what personal information we collect, why, who we share it with, how long we keep it and what rights you have. Terms not defined here are defined in the A.L. Terms of Use.

2. Information we collect, by service

2.1 A.L. Account

  • Name and email address

  • Password (stored hashed) [CONFIRM: Amazon Cognito]

  • Record of which version of our terms and policies you accepted, and when

2.2 Purchases from our online store Purchases are sold and billed by our merchant of record (currently Lemon Squeezy), which is an independent controller of the payment data it collects. From them we receive your name, email address, country, and order details. We do not receive or store your full payment card details.

2.3 License codes and licensing (A.L. Licensing System)

  • License code, the product it unlocks, and which distributor or store it came from

  • Date claimed and the A.L. Account it is linked to

  • Activation records: device identifier, IP address, operating system, plug-in version and host (DAW), and activation and deactivation timestamps

  • License transfers and refunds

Audio you process with our Plug-Ins stays on your computer. It is never sent to us.

2.4 Support and communications Emails, support tickets and any attachments you send us.

2.5 Marketing Your email address and your opt-in record, if you choose to receive our newsletter or offers.

2.6 Websites and cookies IP address, browser and device information, and pages visited. We use necessary cookies to run the site and keep you signed in, and functionality cookies to remember your preferences. [CONFIRM whether we use analytics or advertising cookies/pixels; if we do, we need a consent banner for EU/UK visitors and this section must list them.]

 

3. How we use your information, and our legal basis

4. Who we share it with

We do not sell your personal information, and we do not share it with third parties except as described here:

  • Our merchant of record (currently Lemon Squeezy) — sells and bills store purchases as an independent controller.

  • Hosting and infrastructure — Amazon Web Services, US East 1.

  • PACE Anti-Piracy / iLok — for licenses delivered or activated through iLok.

  • Authorized distributors (Eventide, Plugin Boutique, XChange) — limited to what's needed to handle refunds, chargebacks and invalid license codes. They are independent controllers for their own sales.

  • Service providers — email (Mailchimp), acting on our instructions under written data processing terms.

  • Legal and safety — where required by law or valid request from public authorities, or where necessary to protect our rights, investigate wrongdoing, protect personal safety, or protect against legal liability.

  • Business transfers — in connection with a merger, sale or other transfer of our business or assets, subject to confidentiality.

Everyone. You can ask us to access, correct or delete your personal information, or to stop sending you marketing, by emailing support@newfangledaudio.com.

If you are in the EU, UK or another jurisdiction with similar law, you also have the right to object to or restrict processing, the right to data portability, the right to withdraw consent at any time, and the right to complain to your data protection authority.

Deleting your account. If you ask us to delete your account we will, but we will keep the minimum record needed to honor licenses you have bought, to meet tax and accounting obligations, and to prevent fraud.

 

8. International transfers

We are based in the United States and our systems are hosted there. If you use the Services from outside those countries, your information will be transferred to and processed in the United States.

 

9. Security

We use Amazon Cognito and AWS cloud security technology to protect your information from unauthorized access, destruction, use, modification and disclosure.

You may create an account with a username and password. You are responsible for keeping your credentials confidential and for activity under your account.

No method of transmission over the internet or method of electronic storage is completely secure. While we use commercially reasonable means to protect your personal information, we cannot guarantee absolute security.

 

10. Children

The Services are not intended for use by anyone under 18. We do not knowingly collect personal information from anyone under that age. If you believe a person under that age has provided us with personal information, contact us and we will delete it.

 

11. Links to other websites

The Services may include links to third party websites. We have no control over and are not responsible for the privacy practices of third parties or the content of linked websites. We encourage you to read the applicable privacy policies and terms of such third parties.

 

12. Changes to this policy

We may update this policy. If we make material changes, we will notify you by email to the address associated with your A.L. Account or by a notice on our websites, before the change takes effect. The current version and its effective date will always be posted here.
